Participant Disclaimer

By booking to attend an event with Swim the Lochs, you are agreeing to the following terms:


1. Assumption of Risk

Outdoor swimming is an activity that carries inherent risks. While every effort is made to minimise danger, all participants take part at their own risk. Swim the Lochs cannot be held responsible for accidents, injuries, or incidents that occur if you do not follow guidance, fail to disclose relevant information, or act negligently.


2. Risk Identification and Acceptance

By signing this disclaimer, you acknowledge and accept the following risks, which include but are not limited to:

  • Collision with submerged or visible objects in the water
  • Injury from wildlife in or around the area
  • Injury when entering or exiting the water
  • Accidents en route to the venue, on foot or by vehicle
  • Risks associated with additional activities such as fire-pits, sauna sessions, or food consumption
  • Swimming in higher-risk areas such as rivers, waterfall pools, or the sea
  • Sickness or disease from polluted water
  • Hypothermia
  • Drowning
  • Increase in heart rate and blood pressure upon entering cold water

Full risk assessments are carried out, and all reasonable adjustments are made to minimise risks.


3. Personal Responsibility & Competence

By booking, you confirm that you:

  • Are over 18 years of age
  • Are a competent swimmer and physically fit to participate
  • Have assessed your own ability against the advertised activity description
  • Accept responsibility for your own safety and wellbeing during the event

4. Insurance and Safety

Swim the Lochs holds appropriate insurance, and full risk assessments have been completed. For your safety, you must follow all instructions given by your guide. Failure to do so may place you or others at risk and may result in removal from the session without refund.


5. Medical Disclosure

It is essential that you disclose any medical conditions that may affect your ability to participate, including but not limited to:
cardiovascular issues, asthma, pregnancy, high/low blood pressure, diabetes, atrial fibrillation, or urticaria.
Failure to disclose relevant medical information may invalidate your participation and insurance cover.


6. Alcohol and Drugs

You must not attend if you are under the influence of alcohol or drugs. Swim the Lochs reserves the right to refuse participation if there is reasonable suspicion that a participant is unfit to take part. No refunds will be given in such circumstances.


7. Emergency Procedures

In the event of an emergency, participants agree to follow all instructions given by Swim the Lochs staff. Emergency services will be contacted where necessary, and associated costs remain the responsibility of the participant.


8. Weather & Environmental Conditions

Events may be altered, postponed, or cancelled at short notice due to unsafe water, adverse weather, or other factors beyond our control. Swim the Lochs will not be liable for costs incurred as a result.


9. Belongings & Personal Property

Swim the Lochs accepts no responsibility for loss, theft, or damage to personal belongings brought to an event. Please avoid bringing valuables where possible.


10. Photography & Consent

Photographs and/or video recordings may be taken during events for use in Swim the Lochs publicity, social media, and marketing. By attending, you consent to being included in such images unless you notify us in writing prior to the event. All reasonable steps will be taken to respect your preference.


11. Data Protection (GDPR)

Personal data collected through bookings will be stored securely and processed in accordance with UK GDPR regulations. Data will not be shared with third parties without your consent, except where required by law.


12. Participant Behaviour

All participants are expected to act responsibly and respectfully towards others, the environment, and local communities. Swim the Lochs reserves the right to refuse or terminate participation if behaviour is unsafe, disruptive, or inappropriate.


13. Liability Waiver

By attending a Swim the Lochs event, you agree that Swim the Lochs, its owners, employees, and partners shall not be held liable for any loss, damage, injury, or death, except where liability cannot be excluded under UK law.
